Logo & Artwork Copyright & Trademark Terms

In the event we are directed by the customer to use any logo, artwork or copy/redraw of material supplied by the customer to produce an order, it is agreed and understood that we shall be acting as the agent of the customer in the use of such materials. The customer, as principal, shall be responsible to comply with all laws regarding copyright, trademarks, patents, rights of privacy, licensing or similar rights of protection and shall indemnify and hold harmless Red Canoe Promotions for any suits, claims or actions of any nature for damages, expenses or costs which may arise by reason of Red Canoe Promotions using said material in accordance with the customer direction, all of which shall be considered within the scope of the aforementioned agency relationship. Copy and trademarks illustrated on our website and marketing materials are used to demonstrate product imprinting. This does not constitute endorsement of our products by any company. Any artwork prepared by Red Canoe Promotions remains the property of Red Canoe Promotions until the item we're printing the artwork on has been purchased, or until Red Canoe Promotions has been compensated by the customer for the artwork/design services.

Payment

We accept checks, all major credit cards, and ACH payments.  Red Canoe Promotions reserves the right to request wire transfer payment on any order.  To cover the cost of processing a credit or charge card transaction, and pursuant to section 5-2-212, Colorado Revised Statutes, a processing surcharge of 2.9% will be assessed on all credit card payments in the event that alternate payment methods are available.  This fee only applies to credit card transactions (there is no fee for check or ACH payments).

Turnaround Time & Delivery

Turnaround times vary depending on the product and decoration method.  The "In-Hands" date listed on your order is based on immediate approval (and payment for prepay customers) and is calculated using published transit times for our freight carriers (UPS or FedEx in most cases).  Occasionally, unexpected events such as public health emergencies, adverse weather conditions or higher than normal volume may cause delays with the carrier.  We are unable to provide refunds in the event of a delay with the shipping carrier.

 

Shipping

Unless stated otherwise, shipping is additional (or estimated) and will be added to total when order is invoiced.  Any shipping estimates are based on delivery to a commercial address. Our products ship from various warehouse locations, and shipping & handling charges are billed based on the F.O.B. shipment origin for your particular order. Title of goods passes to you, the purchaser, at the F.O.B. point. All goods are shipped uninsured at the purchaser's risk and claims should be made directly with the freight carrier for any delayed, lost or damaged shipments. If you'd like to purchase a higher limit of liability for your shipment than what is offered for free by the carrier, please notify us before approving your order. Please ensure someone will be available to accept delivery of your shipment. Red Canoe Promotions is not responsible for weather damage or theft when packages are left at the door. Any packages requiring a signature may be returned to the sender if nobody is present to accept delivery, resulting in additional shipping charges from the carrier. Please be advised that if your order is shipping to CA, Prop 65 warning labels may be placed on your items where required by law.

 

Order Cancellations

Once all approvals have been received, your order will proceed to production.  Once production has begun, it will not be possible to cancel your order.  If your order has not yet entered the production phase, you may be able to cancel your order.  The cancellation fee, if any, will vary depending on the nature of your order and how far your order has progressed.

 

Overruns/Underruns

An overrun or underrun of up to 5% is the industry standard and is considered acceptable on all promotional products.  Paper products (such as folders, business cards, stickers, brochures and other such collateral) can have an overrun of up to 10%.  Any overruns or underruns will be invoiced accordingly.

 

Returns/Refunds

Since promotional products and logo apparel are permanently decorated with your logo, all purchases are final unless there is a manufacturing defect with the product, or if there is an issue with the decoration/printing. Samples are available to order for most products to ensure the promotional product or garment will meet your expectations. If there's not enough time to order a sample due to a firm in-hands date or if the purchaser otherwise decides not to order a sample, the purchaser acknowledges that returns or reimbursement of any kind will not be accepted unless there's a manufacturing defect or imprinted artwork that isn’t consistent with approved digital proof(s). Please inspect your order upon arrival and let us know of any issues within five working days.

 

Credit Terms

In the event Red Canoe Promotions, Inc. has issued credit to you, you agree to promptly pay all bills in accordance with the terms expressed on your invoice. You further agree that if any amount is past due, it shall bear interest at a rate of 1.5% per month until paid. A credit hold will be applied until any past due amounts are received.  In the event that any suit or action is instituted to collect money due on your account, whether principal or interest, or both, you agree to pay, in addition to the amount owed, all legal fees and collection agency fees incurred (in accordance with Colorado State Law), including a reasonable sum for attorney’s fees. You understand that if any amount is past due, Red Canoe Promotions, Inc. reserves the right to revoke any Net credit terms for future orders. Red Canoe Promotions, Inc. will accept payment for invoices by check, credit card or ACH.  Amount due is in US Funds.  A fee of $25 will be assessed on all returned/reversed payments.
